Purchase terms and conditions

1. General provisions

1.1.These rules for the purchase and sale of goods (hereinafter – the Rules) are a legal document binding on the Parties, which sets out the rights, obligations and liability of the Buyer and the Seller when the Buyer purchases goods in the paveikslai.com online store.

1.2.The Seller reserves the right to change, amend or supplement these Rules at any time, taking into account the requirements established by legal acts. The Buyer is informed of any changes on the paveikslai.com online store website. When the Buyer shops in the online store, the Rules in force at the time the order is placed apply.

1.3.The following persons have the right to buy in the online store:

1.3.1.Natural persons with full legal capacity, i.e. persons who have reached the age of majority and whose legal capacity has not been restricted by a court;

1.3.2.Minors aged 14 to 18, only with the consent of their parents or guardians, except where they may independently dispose of their own income;

1.3.3.Legal entities;

1.3.4.Authorised representatives of all the persons listed above.

1.4.By approving the Rules, the Seller also guarantees that, in accordance with clause 1.3 of the Rules, the Buyer has the right to buy goods in the paveikslai.com online store.

1.5.The contract between the Buyer and the Seller is deemed concluded from the moment when the Buyer, having filled a shopping cart in the paveikslai.com online store, specified the delivery address, chosen the payment method and read the Seller's Rules, clicks the “Order and pay” button (see clause 5 “Ordering of goods, prices, payment procedure and terms”).

1.6.Each contract concluded between the Buyer and the Seller is stored in the paveikslai.com database; the Buyer receives an order confirmation with the details of the order by e-mail.

2. Privacy policy and personal data protection

2.1.How we process personal data, which cookies we use and what rights you have is set out in a separate document, the Privacy Policy.

3. Rights and obligations of the Buyer

3.1.The Buyer has the right to buy goods in the paveikslai.com online store in accordance with the procedure set out in these Rules and in other information sections of the paveikslai.com online store.

3.2.A Buyer who is a consumer has the right to withdraw from a distance contract of sale, without giving a reason, within 14 (fourteen) calendar days from the day the goods were received, as described in section 8 of these Rules. The right is excluded only in the cases set out by law (see clause 8.10).

3.3.A Buyer who uses the right in clause 3.2 is liable only for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

3.4.The Buyer undertakes to accept the ordered goods and pay the agreed price for them.

3.5.If the contact or delivery details given in an order change, the Buyer must inform the Seller without delay.

3.6.A Buyer who is a consumer is covered by the statutory guarantee of quality (see section 7).

3.7.By using the paveikslai.com online store, the Buyer agrees to these Rules of purchase and sale and undertakes to comply with them and not to violate the legal acts of the Republic of Lithuania.

4. Rights and obligations of the Seller

4.1.The Seller undertakes to create all conditions for the Buyer to properly use the services provided by the paveikslai.com online store.

4.2.If the Buyer attempts to harm the stability and security of the Seller's paveikslai.com online store or breaches their obligations, the Seller has the right to restrict or suspend the Buyer's access to the online store.

4.3.The Seller undertakes to respect the Buyer's privacy and to process the personal data given in the order form as described in the Privacy Policy.

4.4.The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.

5. Ordering of goods, prices, payment procedure and terms

5.1.The Buyer can shop in the paveikslai.com online store 24 hours a day, 7 days a week, unless the online store is unavailable due to technical maintenance.

5.2.The contract enters into force from the moment the Buyer clicks the “Order and pay” button and the Seller, having received the order, confirms it by sending a confirmation e-mail to the e-mail address provided by the Buyer.

5.3.Prices of goods in the paveikslai.com online store and in the order are stated in euros, including VAT.

5.4.The Buyer pays for goods in one of the following ways:

5.4.1.Advance payment using a pre-filled form, by bank transfer via the secure PAYSERA payment system – by selecting the logo of your bank from those shown in the payment window, you will pay without entering any additional data. After selecting such a link, the customer is redirected to their bank's system, where it is enough to log in and confirm the payment of the final amount calculated in the order for the selected goods. The order form is filled in automatically, and the Seller is informed of the successful payment immediately, regardless of the online banking system used and/or the time of day. This speeds up the preparation, dispatch and delivery of goods. Lower transfer fees apply when paying via the PAYSERA payment system. All terms, privileges and rules of the intermediary PAYSERA apply to a customer paying by this method.

5.4.2.Payment by ordinary bank transfer – this is advance payment, where the Buyer makes a local payment transfer directly to the UAB VILOGA PAYSERA bank account. The payment details are provided before the order is confirmed and are also shown on the pro forma invoice and the VAT invoice. A customer who does not use online banking can print the invoice and make the transfer at their bank branch. In the “Payment purpose” field of the payment form, the Buyer must state the order number given in the order confirmation e-mail. Bank fees for transferring money to the UAB VILOGA PAYSERA account are not included in the customer's invoice for the goods. The Seller is not responsible for the application and/or amount of such fees. Before making a bank transfer, make sure that you have confirmed the order and received an e-mail confirming it; otherwise the order is not registered in the system. Attention! When paying this way, funds are credited only in accordance with the standard procedure of your online banking provider (your bank), and transfers are credited only at certain intervals on certain days. A customer paying this way must be familiar with the duration and accuracy of money transfers under the terms of their bank; in this case the Seller is not responsible for how long it takes for the funds to be credited, and fulfilment of the order begins only once the funds have reached the UAB VILOGA PAYSERA bank account.

5.5.A Buyer who has chosen payment by bank transfer undertakes to pay for the goods without delay, as the parcel is prepared and the dispatch period starts only once payment for the goods has been received.

5.6.An order confirmation with the order total and the payment details is sent to the Buyer's e-mail address as soon as the order is placed. A VAT invoice is issued after payment and provided with the goods or by e-mail.

6. Delivery of goods

6.1.The delivery charge is shown during checkout, before the order is confirmed, and is included in the total: LP Express courier within Lithuania – 5 EUR, or free of charge for orders of 99 EUR or more, delivery to other countries – 35 EUR, collection in Vilnius – free of charge.

6.1.2.Because of their size, paintings travel by courier only – they cannot be sent through parcel lockers. The charge is the same however many paintings are in one order.

6.2.A Buyer who chooses the delivery service when ordering undertakes to specify the exact delivery location.

6.3.The Buyer undertakes to accept the goods personally. If the Buyer cannot, another adult at the address the Buyer gave may accept them.

6.4.All goods are delivered by the LP Express courier service to the address specified in your order information.

6.4.1.Orders may be collected free of charge in Vilnius, at Vilkpėdės g. 10 (building 20), on working days: Mon–Thu 9:00–17:00, Fri 9:00–16:00. Please call +370 699 90 607 before coming. Payment must have arrived before collection.

6.5.Parcels are delivered on business days. The courier service informs the Buyer of the expected delivery time.

6.5.1.If the customer wishes to receive the goods urgently, the customer must contact the Seller and discuss additional delivery options. To receive the goods in other ways, please contact customer service: paveikslai.com “CONTACTS”.

6.6.It is not possible to ask the courier to deliver the order at a specific time (except where the Buyer makes a separate arrangement with the Seller regarding delivery in accordance with clause 6.5.1 of these Rules).

6.7.The estimated delivery time in Lithuania is 3–5 business days after payment is received if the goods are in the Seller's warehouse, and about 5 weeks if the reproduction has to be made.

6.8.The Seller delivers goods to the Buyer within the periods stated in clauses 6.7 and 6.15 of these Rules. These periods are indicative. The Seller tells the Buyer by e-mail whether the ordered goods are in stock or have to be made, and when they are expected to be delivered. The Buyer also agrees that, in exceptional cases, delivery of the goods may be delayed due to unforeseen circumstances beyond the Seller's control. In such a case, the Seller undertakes to contact the Buyer without delay and agree on the delivery terms.

6.8.1.Goods in the Seller's warehouse are delivered to the Buyer anywhere in Lithuania within 3–5 business days after payment for the order. Once the goods have been dispatched, the Buyer is notified by an automatic e-mail.

6.8.2.If an order is placed before 15:00 on a business day but is paid later by bank transfer or via the PAYSERA direct payment system, dispatch of the order is moved to the next business day and the delivery date is postponed by two business days.

6.8.3.Any payment for an order made after 15:00 on a business day, or at any time on a non-business day, moves dispatch of the order to the next business day.

6.9.Ordered goods are always delivered in a single shipment, and the Buyer is informed individually about different delivery times for different goods. Several ordered goods may be delivered in separate shipments at the customer's request for an additional standard delivery fee in accordance with clause 6 of these Rules.

6.10.In all cases, the Seller is released from liability for breach of delivery deadlines if the goods are not delivered to the Buyer, or are delivered late, through the fault of the Buyer or due to circumstances beyond the Seller's control.

6.11.On delivery we recommend checking the outside of the parcel while the courier is still present. If the parcel is damaged, we advise noting it on the courier's document or refusing the parcel.

6.12.Notes on the courier's document and photographs of damaged packaging help to settle a claim faster, but their absence does not take away the Buyer's rights regarding defects in or damage to the goods.

6.13.Please inform the Seller without delay if a parcel arrives in damaged packaging, contains goods that were not ordered, the wrong quantity, or an incomplete item.

6.14.The risk of accidental loss of or damage to the goods passes to the Buyer when the Buyer, or a person indicated by the Buyer other than the carrier, takes possession of them.

6.15.Delivery outside Lithuania can be ordered on the site: choose the country during checkout and the charge is 35 EUR, with an estimated delivery time from the payment arriving of 1–3 weeks if the goods are in the Seller's warehouse, and 6–8 weeks if the reproduction has to be made. We currently deliver to the European Union, the European Economic Area, the United Kingdom and Switzerland. For anywhere else, write to info@paveikslai.com.

6.15.1.For deliveries to countries outside the European Union (the United Kingdom, Switzerland, Norway, Iceland, Liechtenstein), import VAT, customs duties and customs handling fees may be charged in the destination country. They are not included in the price of the goods or of delivery and are paid by the Buyer.

6.16.For delivery to the Curonian Spit, please contact us before ordering: if the carrier charges a supplement, we agree its amount before the order is placed. No additional delivery charges are applied after an order has been placed.

7. Quality of goods and warranties, warranty service

7.1.The details of each item sold in the paveikslai.com online store are given in the description accompanying that item.

7.2.The colours and shades of goods on screen may differ slightly from the real ones because of the characteristics of the Buyer's display.

7.3.The customer always has the right to contact info@paveikslai.com, and we will do our best to provide prompt assistance or the necessary information regarding the return or exchange of an item. When contacting us, please state the order number, purchase date, and the buyer's first and last name or company name.

7.4.The goods carry the statutory 2 (two) year guarantee of quality, counted from the day they are handed over to the Buyer. If a defect appears within that time, the Buyer has the right to have the item repaired or replaced free of charge or, where that is impossible or disproportionate, to a price reduction or to end the contract and receive the money back (see section 8).

8. Return and exchange of goods and/or refunds

If you wish to cancel an order whose goods you have not yet received, or to withdraw from particular item(s) of an order that has been paid for but not yet fulfilled, and get your money back, please let us know as soon as possible by e-mail: info@paveikslai.com. Otherwise, please follow the rules below:

8.1.Defects in goods sold are remedied, and defective goods are exchanged and returned, in accordance with the Civil Code of the Republic of Lithuania and the Rules of Retail Trade.

8.2.A Buyer who is a consumer may withdraw from the contract, without giving a reason, within 14 (fourteen) calendar days from the day the goods were received (where goods in one order are delivered separately, from the day the last one was received). It is enough to tell the Seller before the period ends: by completing the withdrawal form on this site, or by e-mailing info@paveikslai.com the model form in clause 8.11 or any other clear statement. The order number (for example VL-00042) is in the order confirmation e-mail.

8.2.3.The Seller refunds all payments received from the Buyer, including the cost of delivery (except any extra cost arising because the Buyer chose a delivery method other than the least expensive one offered), no later than 14 calendar days from the day the Seller is told of the withdrawal. The Seller may withhold the refund until the goods are returned or the Buyer has provided proof of having sent them.

8.2.4.Returning or exchanging defective goods costs the Buyer nothing. On withdrawal from a contract for goods of proper quality, the Buyer bears the direct cost of returning them. The Buyer sends or brings the goods to Vilkpėdės g. 10 (building 20), 03151 Vilnius, no later than 14 calendar days from the notice of withdrawal.

8.2.5.Money is returned the way it was paid: a bank transfer goes back to the payer's account, and a payment made through Paysera is returned through Paysera.

8.3.When returning goods, please observe the following:

8.3.1.Pack the item so that it is not damaged in transit – in its original packaging where possible;

8.3.2.The item must not have been damaged by the Buyer;

8.3.3.The item must not have been used beyond what is needed to establish its nature and characteristics (this does not apply when a defective item is returned);

8.3.4.The returned item must be as complete as when the Buyer received it;

8.3.5.When returning an item, give the order number or provide other proof of purchase.

8.4.If a returned item is damaged or has been used beyond what is necessary to inspect it, the Seller may deduct the item's loss of value from the refund.

8.5.When a wrong item and/or a defective item is returned, the Seller undertakes to take back such goods and replace them with equivalent suitable goods.

8.6.Where the Seller has no suitable goods for an exchange, the full amount paid, including the cost of delivery, is refunded to the Buyer within 14 calendar days.

8.7.Paveikslai.com has the unilateral right to deduct the amount of an additional discount granted from the amount refunded to the customer if the customer used an additional offer discount and later cancelled (returned) at least one item of proper quality from the offer to which the discount was applied.

8.8.Where the reason for the return is improper quality, paveikslai.com undertakes, at its own expense, to replace the item with one of proper quality or to refund the money paid for it, in accordance with the Civil Code of the Republic of Lithuania.

8.9.Some paintings in the gallery are one of a kind, so on rare occasions an ordered painting is no longer available. We then contact the Buyer at once, cancel the order and return the whole sum paid, delivery charge included, within 14 calendar days at the latest. The Buyer may instead choose another painting.

8.10.The right to withdraw within 14 days does not apply to legal entities, or to goods made to the Buyer's specifications or clearly personalised (individual orders). This does not limit the Buyer's rights regarding defective goods.

8.11.Model withdrawal form (complete and send it only if you wish to withdraw from the contract). To: UAB VILOGA, Vilkpėdės g. 10 (20), 03151 Vilnius, info@paveikslai.com.
